Direct Debit problem

Is there any redress if a firm in this case it is a gym continues to take money by direct debit after they have been asked not to? My son asked that the January payment be the last but they have taken February and March (I have already called him everything for not spotting the February payment had been taken and sorting it out then). He has not been to the gym since before Christmas and their records will obviously show that to be the case. Is it a case of pay more attention next time or can he get his money back?

    Of course he can get his money back and it`s down to HIS bank to refund any payments taken in error.
    The other thing he should have done and needs to do IMEDIATELY is to cancel his DD

    If an error is made by the organisation or your bank or building society, you are guaranteed a full and immediate refund from your branch of the amount paid.
  • You also need to cancel the DD with the Bank, as well as the organisation collecting payment.

    Hate to tell you this, but it is possible that he will not be able to claim his money back. How did he instruct the gym to cancel his membership? Verbally or in writing? What proof does he have? Receipt from gym or recorded delivery?

    Thanks every one. He told the girl on the desk, she had a look on the computer and said she would sort it out. He has been ringing them but nobody ever rings back and he has now moved away from the area which is why he left so cannot just pop in. He has since been to the bank and stopped it from their end and sent a letter to the gym.
