Company dragging their heels over redundancy decision

I was told more than 6 weeks ago that I was under threat of reduncancy. Following a tip off from two senior managers that the decision was based purely on personal reasons and was effectively a witch hunt against myself and my colleague, I met with HR and put the evidence to them that it was in fact constructive dismissal and listed 3 (out of several) pieces of tangible evidence. I asked for a without prejudice discussion to negotiate a financial settlement and haven't heard from them since.

They have met with my colleague and asked how much he would be willing to settle for, promising an answer early this week. He hasn't heard anything either.

The situation is putting great strain and stress on my ability to continue working in a company that I know no longer wants me there and all the staff are under the assumption I'm going to be leaving and can't understand why nothing is happening.

I don't feel able to close one chapter and move onto the next thing until this is resolved and believe this to be unfair and unacceptable.

I'm looking for some words to put to them to force their hand and get the ball rolling.

    You can't really force their hand

    it is their decision to make you redundant (or not) and their decision to issue a compromise agreement (or not).

    I appreciate how hard this must be, but at this stage all you can do is ask them what their intentions are. Once you know the answer people can help more, but until you have an agreement to make you redundant (not just at threat), and a decsion to offer a CA - there is little anyone can do.

    I think that would require a resignation.

    Do you mean unlawfull or unfare dismisal if they terminated

    you may have given them enough heads up to get themselves out of any mess.

    What if they just stopped any proccedings and you kept your job?

    I have taken advice from a solicitor who has already successfully argued 2 out of 2 cases of unfair dismissal within the same company.

    He assures me any attempts for the company to move the goal posts now would be argued in court as a cynical attempt to improve their position and thus avoid financial and/or legal penalties. The information I have given them is only the tip of the iceberg but just enough to let them know I'm not just blowing wind up their !!!!!!. The senior managers in question have both said they would stand up in court and tell nothing but the truth if so asked.

    I have it on good authority that the person cultivating the redundancies has said if we keep our jobs this time, he won't be so lax in collecting evidence against us in the future making our positions untenable under any circumstances.

    We now have a meeting next week as part of the next stage of the consultative process when I believe they will make their intentions clear.

    Hopefully we will then know what we are playing with.
