received item not as described what to do?

I brought a top off ebay froma seller with 100% feedaback that was used but listed as perfect conditon however on recieving its far from the condition listed including several stains.
I've messaged the seller but had no response though they dont except returns anyway.
what would you do in this case? should I just leave neg feedback?

Depending on the value of the item, you could always force a refund through eBay.

I would email the seller to let them know there are stains on the top and see what they say. It may be a case that they didn't notice the stains and a decent seller should let you return it for a refund.
If, however, they do not respond after a few days or refuse to offer a refund, then open a significantly not as described case on ebay. You will then need to send the item back via a trackable method (special delivery / courier) for a refund. So it does depends on how much the top cost you as it may not be worth sending it back for a refund.
PS. It doesn't matter what the seller says, if it is significantly not as described, then you can return it for a refund0
