I have received the N244 hearing date today, is it not worth attending
The FOS were really nice that have taken the other policy on and it was the FOS who informed me about court action on this one as HSBC would not let the FOS look into this one
The FOS stated that the banks had to follow the DISP ?? guildelines0 -

When I was looking into going to court I asked the question about the three year time limit when I could have known that I had a real chance of winning and was advise that I could use the judicial review of 2011 at being the point that the three years began

ou can use section 32 of the limitations act which states that its not statute barred if you only just became aware of this and therefore it can be overuled. (i think that is how it works). There is also another thing that the banks can put in their letters and that is the 3 year rule which says that "you should have reasonably been aware of this complaint within 3 years" but this is not the case in most cases as we only just became aware of all this misselling through the media attention to it.0

But you cannot use that because the bank can use the FOS correspondence to prove that you WERE aware.

I am so cross as HSBC were the ones that had told me the policy was incorrect in 2008 in a discussion with the FPM
Its seem unfair that some people were not even mis sold and they automatically get their monies back
HSBC did not respond in time to the court action and therefore received a CCJ , but now they want to defend!!
Do think it is worth me looking into time limitation act 1980 EXCEPTIONS?? I did read that the it is the judges decision and HSBC are the ones that have taken three years,
In 2012 HSBC did write to me and state they have looked into again and their decision was the same??:mad:0
