IS is a means tested benefit, so would depend on your husband's income. As he's full time I doubt it, you could be entitled to tax credits though.

You can double check your entitlements on the Turn2us online benefit calculator.

Generally IS is a top-up for a low household income, such as lone parents whose youngest child is under 5 and households with just disability/sickness benefits as their sole income.

Since your husband is in full time employment, which even on National Minimum Wage would be around 11k, this income would be taken into account and will probably rule out IS.

For households with low income and children where the parents work 24 hours per week at least (with one parent doing at least 16 of this), they may qualify for working tax credits. The Turn2us online benefit calculator will calculate any benefit entitlements.

As said you would not be able to claim I.S, as your partner works over twenty four hours per week
  • You won't qualify for IS as your joint income is too high. However, as your son is in receipt of DLA, you should inform Child Tax Credits, as there is an additional amount paid for children who get DLA. Apologies if you have already done this.
