Do I inform DWP of split?

I have just split with my partner, prior to being with him I claimed incapacity, dla and income support and LHA as I have been very very ill.

When we moved in together I lost income support and LHA due to his income.

We have now split up, but have 4 months left on our tenancy, we have agreed that we will stick it out to the end as I can not afford to leave, I have no money saved for a deposit etc... as soon as I can move out I will, but until then I have moved to the other bedroom and we will live like housemates.

I do not expect to be allowed to claim income support again or LHA as i doubt they would believe we are split up and I dont want to risk being accused of fraud. Plus I hope to be working soon as I am going to go into a supported working environment to see if I can manage it now I am getting better.

So my question is, do I now need to tell the DWP we have seperated or is it not worth it as they prob wont believe me anyway, and also I will be stopping my claim as soon as I start to work.

  • How is your current income made up?

    It is possible to claim in your own right whilst still living with a former partner - you just need to satisfy the DWP why you are doing it. Starting to separate your finances is a good start.

    DLA isn't means tested so there is no need to inform the DWP in regards to this benefit. Also you can work and get DLA - it is based on the needs of the claimant, not their personal working/financial situation, so do not close the claim just because you've started working.

    I would get in touch with the council housing department to see if there is any help they can offer in regards to housing.

    Notmyrealname is giving good advice there. DLA is not means tested and you remain eligible whether or not you are working. I would definitely go to your local authority housing department as they may be able to help you get rehoused. You may be classed as vulnerable and in priority need of housing so it's worth going along to find out what you're entitled to. As regards your other benefits I would ring the DWP and inform them of your change of circumstances and see what they say.

    Whether you get more money or not, splitting up is a change of circumstances you are required to notify of.
