    how long should a landlord take to make up his mind over saying
    "spend £80 on a replacement"
    or
    "tell the tennants to buy there own and have the item removed from the inventory"
    ?
    Is there a timeframe/a code of conduct to follow ??
    My agreement states to keep the property in good/tidy order, which i can't do without the tools...

    In effect, you need to "team up" with the agent here. Write a letter that is addressed to the landlord and send it via your agency. In it, explain clearly, succinctly and factually what the issue is and suggest how you would like it to be resolved. Suggest that you would expect a response within 14 days. Having both you and the agent pushing the landlord at the same time should increase the pressure on him/her and, in many cases, makes them more likely to respond.

    Putting this in writing via your agent also provides you a record of what has been said, which will be useful when it comes to reclaiming your bond. If you have a full and complete record of you reporting and trying to remedy the problem, the agent or landlord cannot hold this against you.

    There is no real fixed timeframe for repairs as some issues are, understandibly, more urgent than others. However, if the garden could be considered to be an environmental health issue, you can report this to the local authority.

    For all the stress that this is causing I would just buy a second hand mower of the same type listed in the inventory and accept that it's a disposable item. At the end of your lease if the LL wants it would give / sell it to him, if he doesn't I would either keep it or sell it on via ebay.

    To note peeps, the LL has told the LA to say he wont replace the Mower, and for me to do so....
    I dont have an issue with this :)

    The problem i got (and still got), is the Mower is on the inventory, and despite 5 requests, cannot get it in writing that the mower is no longer part of the inventory....

    So this means (and as confirmed by the LA), that should i move out whenever i do, if a mower is not present at the property, as per the inventory, an amount would be withheld to replace the unit....

    The LA cant give it to me in writing, until the LL gives it to them in writing...
    Would be nice if the 'reply posters' could see beyond there nose with some questions :) (no offense intended)

    Ask the LA how much they think a broken down Flymo lawnmower goes for on the market, because certainly that would be the upper limit they could claim...

    I suppose that you have the communication with the agent regarding the lawnmower and the landlord's refusal to replace in writing.
  • If you have reported the mower as broken and the landlord has acknowledged this via the agent and has decided they don't want to replace it there is no need to have it struck off the inventory. You have a paper-trail about what has happened to it for when you move out. I suspect you might be over-thinking all this, quite honestly.

    Just reply back to their email and state that you intend to dispose of it in x number of days unless you hear back from them. Print off that email and keep it somewhere safe for your check-out.

    the only trail in 'Writing' comes from me.....
    I dont have any replies from the Letting Agent, its only verbally i've been told that the LL doesnt want to buy a new mower...

    I played the scenario out to one of the staff, as to what happens if i move out and an item, such as a mower is missing.... they said they will take a cut from the bond to buy another one....

    LL acknowledges to the LA verbally, but the LA wont do anything unless they have it in writing...
    Not over-thinking, just working on past experience and being semi busted many years ago :)
