Esa tribunal success

Hi.

Just thought I would let people know how I got on through this journey.

I have a number of illnesses, including Crohns Disease and depression. I had been on Incap Ben for a number of years and went for a medical last year for ESA. I got 0 points and lodged my appeal immediately.

I have waited a year for today (tribunal day!) and have been a wreck about it. I submitted a lot of evidence a fortnight ago.

Anyway, I went in and had a doctor and lawyer on the panel. They apologised that we had to go through this process and if they could just ask me a couple of questions about the Crohns then hopefully they would not need to ask me anything further. I was in the room for 5 mins and was asked to sit outside while they made a decision. I was called in a few mins later and they said they were putting me in the Support Group, I think they said something about a level 3 or something, but as I was in a state I cant be sure what they said actually. I became a grovelling mess when they passed it through, and was crying and told them how awful this past year has been and thank you, thank you. They were lovely judges, thankfully. I bet they were glad they got rid of me ha!

Anyway, I just wanted to let people know that I was put at ease and I was honest with them, even though I hardly said anything.

I dont know what happens now, does anyone?

  • They will write to the JCP who will then adjust your claim accordingly (and arrange for any back payment to be made). This can take up to a month.

    The level 3 is likely to refer to section 3, which is part of the ESA Regulations and means you should be in the Support Group.

    Wow... someone a few days ago said they were only in for 15 minutes before the judge dismissed the ATOS report and found them to meet Support Group criteria... seems you've just beaten that.

    Well done anyway. As above... the tribunal will send the DWP the decision notice.. but the DWP could take quite a while to process it... if you're supplying sicknotes to get assessment rate ESA while you've been waiting for this appeal then continue to supply them until the DWP have processed the decision.

    Just noticing you don't mention the decision notice yourself.. did the tribunal not give you a result slip? If not presumably you will get a copy sent.. or ask the tribunals service for one in a week or so... reference to 3 will probably be schedule 3... reference to the law regarding support group criteria. I do think it important you understand what Support group criteria the tribunal felt applied to you... as in future reassessment you'll probably be making a case for the same applying. If you have or get the results slip and need clarification on details then you could quote them here obviously with any personal info excluded.

    Thank you for that muttleythefrog, the computer wasnt working in the room, so they said they were posting their decision. Yes I think it was schedule 3 they said, I was just sat there thinking, nah I've failed this, I couldnt quite hear them and had to ask them to repeat it.

    I have just had the best sleep in over a year! I am still teary now with elation!
