Hermes Delivery Gone Wrong..

I ordered a hoodie for my boyfriend from River Island as it was reduced to a tenner. Came home today to find a note from Hermes saying that the parcel was by the gate. Walked in to the garden to find the bag ripped open and the hoodie was strewn on the grass with bits chewn off. I've got 2 dogs, and had left the patio door open for them so they clearly thought the parcel was a toy
Is this my fault or the couriers? I'm not sure, but I think it could of been squeezed through the letter box rather than lobbed over the fenc.

The parcel is the responsibility of the seller untill it is delivered - As you never actually took delivery of the parcel it isn't your problem. They should only leave an item if it is in a safe place and only when allowed by the seller... They should be getting a signature too by all accounts...
Basically - It's Hermes' fault for not fullfilling their obligations...Swagbucks:

Ergo it is River Island's fault as they contracted Hermes. Contact RI and explain that the package was received without a signature and was found ripped when you located it. (You don't HAVE to mention the dogs).

Difficult one... as they did deliver the parcel to you without it being stolen, damaged or lost. Had the parcel been stolen it would be their responsibility, however, the parcel was damaged on your premises by your animals...
Despite this, it could be argued they failed in their duty of care by leaving it outdoors where it is vulnerable to loss or damage...
I would be interested to hear others thoughts on this...
Actually whilst thinking about it, the first point would be a terrible defence. They should not have left it where they did. Contact the retailer and explain the parcel has been delivered damaged and see what they say..
Although personally i'd be inclined to contact them enquiring about delivery until they confirm it 'lost'.. it may take a little longer to resolve but as the courier clearly hasn't obtained a valid signature it could be much easier than arguing they are liable for your dogs damaging it.0 -
I've not contacted River Island yet as no idea what to say. I don't want to get the driver in trouble as it technically wasn't his fault, however I feel like I've spent a tenner on a bit of rag!! x0

Don't worry about the driver he obviously was not worried about leaving your parcel in a insecure state.I think the surest sign that intelligent life exists elsewhere in the universe is that none of it has tried to contact us.0
