Car accident...Insurance Question

Hi everyone...I'm after some advice here, I don't know what to do and being bank holiday I cant call anyone to get some answers
Anyway this is the case: Oct 2011 someone went into the back of my car and did a bit of damage (bumper, boot door, lights, etc) the car was still drivable though. It turns out the person had no insurance so because I was fully com, I claimed under my insurance. I take the car to one of their approved garage and the assessor decides its a write off because the repair will cost more than the car is worth bla bla bla. I told them its not good because what they offer me its not enough to get me the same sort of car, so they find another garage who is quite happy to fix the car and all I have to do is pay my excess...happy days...or so I thought. The car was repaired and given back to me, no problems until yesterday when I tried to renew my car tax online and I cant because "A Vehicle Identity Check (VIC) marker has been set against this vehicle record.".:( Could this be a mistake on the insurance company part and they wrongly informed DVLA?? Or was my car a write off even though they fix it?? Some advice is much appreciated. Many thanks Zita

if the insurance company have repaired it then they need to remove the cat C marker.
More generally, are you aware that you can reclaim your excess (and any other out of pocket expenses) from the MIB? (assuming that either the driver or the car that hit you was identified)
What were the circumstances of the other car? Was it completely uninsured or did it have insurance but just not for that particular driver?0 -
Ol I will try to explain and see if I can make sense...Basically the woman that went into the back of my car was driving her husbands car and she thought she was insured to drive it under her own cars fully com policy...which it would have been ok provided that her husbands car had insurance, only it didn't and her insurance refused to pay. Did that make sense? lol...I can confuse myself at times I have got a claim with the MIB for my excess and injury compensation, just waiting to hear from them.0

sounds like you have it in hand....MIB will pay for damage & any injuries plus any other out of pocket expenses and the insurance company need to remove the VIC marker
If you are going to make a habit of this sort of thing it's worth remembering that the MIB claim could have included everything which would have preserved your NCB and avoided a fault claim on your record0 -
Hopefully I wont be having anymore accidents ...The MIB wouldn't pay for the repair because I was fully com, but my NCB were protected so I did not lose them...I will get on the phone to the insurance company tomorrow and hope they will sort this mess out as I need to tax my car. Thanks!!

MIB won't pay for you repair if you have already claimed on your insurance but will if you approach them first0

You can claim from the husbands policy, the MIB will redirect the claim there anyway0

husband didn't have a policy......... the woman that went into the back of my car was driving her husbands car and she thought she was insured to drive it under her own cars fully com policy...which it would have been ok provided that her husbands car had insurance, only it didn't and her insurance refused to pay...........0 -
Great news :j...after oven an hour on the phone to the insurance company, I finally managed to speak to the right person and indeed there was a mistake on the records which have now been updated and my car no longer has a VIC check request on it. Thanks for the advice
