Is 'Shamballa' a registered brand name?

As it says. I'm confused as to what can be called Shamballa, it appears to be a generic name, but does someone have the copyright in the UK? I'm looking for a decent product as a gift, so not sure what I've been asked to get, knowing the person it won't be a £2 bracelet I've been asked for;)

If there is a company that is either called Shamballa or uses it as a brand can you point me in their direction.

    Thanks but that's just added to my confusion. The main site isn't in the UK and the case is in the US.

    If I'm going into a shop or buying on Ebay in the UK, it looks as though anyone can call an item of a certain type 'shamballa' without breaking any law or trademark infringement.

    The trade name “Shamballa Style” is registered in England No: 07699915. The company's registered office address is at 154 Mortimer Street, Herne Bay, Kent, CT6 5DU.

    Cheers. That sort of proves that no one has any kind of trademark on Shamballa as "Shamballa Style" has nothing to do with the "Shamballa jewels" that supplies Harrods and Barney's of New York.

    It looks like 'Shamballa' can be used generically and it's more of the jewels that are the value.

    From what I can gather the expensive company try and block others from selling it but they haven't got any particular legal clout yet, they seem to have stopped a few companies in the US but nothing much here.

    I'm going for a gift voucher as a gift instead!

    The easiest way to answer these kind of question is to go to the IPO website and do a trade mark search - http://www.ipo.gov.uk/tm/t-find/t-find-text/

    There appear to be three cases where a variant of 'Shamballa' has been registered as a trademark, whilst Shamballa Jewels made an application in 2011 which appears to be still in progress.

    That's the problem, it's still in progress. At this point I'm not that bothered, but presumably until that is decided in their favour then anyone can use the name?

  • You cant use the word style on ebay when referring to a brand name. Ebay is fake heaven for shamballa too

    If you read the thread it appears no one has managed to fully trademark the name yet- so the Shamballa items cannot be fakes if there is no trademarked article.

    I know many people have chosen not to risk selling Shamballa on ebay as ebay do tend to be stricter when there is any doubt.
