Employment and Support Allowance stopped

Hi

I was awarded ESA in the WRAG group after successfully appealing the decision made as the result of ATOS's joke medical assessment.

Benefits stopped on April 30 due to the 365 day retrospective legislation rule in the latest revision of the Welfare Act . This affects a large number of people. Many, like myself, cannot shift to Job Seekers as we are not able to satisfy the criteria 'fit for and seeking work'. Nor is the ESA support group available.

Therfore, no job, no benefit, no assistance and living with no income.

How do I get help for my condition ? When can I go back to benefit ?

Please help.

  • You will have income from your partner. That is what couples do, support each other "in sickness and in health".

    You can get help for your condition from the NHS. If you need help seeking work, you can be referred to a Disability Employment Advisor, or an external provider.

    You can go back on benefit when you have sufficient NI Conts to fulfil the CB criteria.

    You obviously have a partner and or savings so that's what you will live on, you aren't being left with no money. Remember though you will still get NI credits as long as you remain eleigible for ESA.

    I am in the same(well near) poistion, my ESA has been stopped, I have been told to apply for JSA but as I'm not fit for work how can I claim a benefit that it meant for people fit and looking for work?

    I see your new here, expect some rude and nasty replies as a lot of people here hate those that claim any benefit for any reason, why they hang out here beats me.

    I think my main point is that having paid 10% NHI and 10% Employers NHI into the Ponzi tax scheme for the entitlement to Benefits. now that work is not possible it is hard to find out that Benefits are now taken away.

    On the upside, I did win part of the recent £148m EuroMill lottery [£2.90] so funds are not a problem until tomorrow

    Dear Topshelf, please contact the CAB (Citizens Advice Bureaux) as soon as possible. This can be online or by 'phone - If I was you I would arrange a visit to the CAB as-soon-as-possible. I could be wrong, but nowadays. most councils and Job Centres turn people down as a matter of course - myself included. but I will win in the end. Good luck!!
  • There's something about that post... hmm... the OP isn't that bloke who's been making multiple accounts and winding everyone up, is it?

    If not... You are expected to live on your savings, other income, or partner's income - whatever has meant you're not entitled to income based ESA. If it's a partner's income, the amounts are very low I'm afraid. On the plus side, if you can get any work at all every £ will be extra income without having to worry about making enough to cover all the bills or working full-time as one does when coming off benefits as a single person.

    Sssh, the nit pickers of the MSE forums don't care about that - they just assume that the op of any topic naturally has it better than them and is asking for help because they have so much money they're stupid.

    Seriously, I couldn't help but wonder the very same thing - especially after the first two replies. One of them even stated "You obviously have a partner" :mad: I hate it when people jump to useless conclusions like that.
