Mobile phone "defective under warranty"

Hello all,
I took out a Blackberry Bold 9900, 24 month mobile contract with Tesco Mobile in October off last year, and stupidly didn't take out any insurance with it (A. It was going to cost me an extra £10 a month, making my contract £50 a month! and B. I had insurance for previous years and NEVER needed it)
After the first few months i had several problems with it, but kept updating my phone and eventually all was well. However, over the past month, after turning it on, the screen remains black, but knowing its on as the backlight shines through it. I can just see the battery bar and signal bar. I have to constantly keep pressing the lock/unlock button until the screen vaguely works again. :mad:
I phoned Tescomobile and explained my problem, wanting to downgrade my contract so i could get a new contract out as i cant be dealing with these phone problems, they said they were unable to do so as a year of my contract hadnt passed - fair enough.
This morning i became very annoyed with my phone, took me almost 2 hours for it to remotely work properly.
A friend contacted me and said that legally, as ive only had my phone a year, it is "defective by warranty"
Can anyone explain what this means? and judging by what ive written, if it DOES apply to me, what i should do?! :undecided
Im at wits end with this phone! ready to throw it at a wall to be honest!!

Your phone is less than a year old, so its under manufacturer's warranty. Really, you should have complained and got it sent off for repair/replacement as soon as the problems started. Contact Tesco and tell them you want it fixed ASAP!0

Contact your local blackberry repair center,Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0
