can an ex wife claim pension after divorce

hi . can anyone tell me if my husbands ex wife of 12 years can now ask about his financial affairs? and mine, she has been re married for about 9yrs.thanks

    Not in respect of a settlement or her own maintenance, this should have been resolved in the divorce. Unless you are talking income (including pension) in relation to child support?

    If the pension was included in the financial settlement negotiations when they divorced then yes, she can. Depends what the agreement said about her remarrying.

    Don't know about other cases but I've been in the County Court literally this morning for pension after divorce reasons. I signed to what we had agreed between ourselves, but the judge reinforced the fact that I have no further claim and cannot backtrack at any time in the future. It is a completely clean break. I guess it depends on what was agreed at the time

    nellyliz your husband needs to look at the financial consent order, agreed at the time of your divorce.

    I don't believe she can legitimately ask about your financial affairs. However, she might be entitled to ask about your husband's financial affairs.

    She may be in receipt of alimony/spousal support, child support or have private pension rights (under a divorce agreement). She may also be entitled to claim her state pension against your husband's NI record (up to the date of divorce), if she hasn't remarried.

    Is she really digging for information or has she merely requested details of his income and/or NI number?
  • You need to establish whether the financial affairs were dealt with at the time of the divorce, it is also relevant who divorced who.

    It may also depend on who is named in the pension agreement - my OH has been paying into a works pension for over twenty years and I am named on that agreement. I would be rather peed off if he divorced me and his new wife thought she was entitled.

    Names can be changed on completion of a nomination form.
  • there was no arrangements made at divorce, there are no children involved she has remarried. she divorced him. i was under the impression that if it wasnt done at the time of the divorce then it was too late ?

    so who is the recipient of his pension? if this wasnt resolved at divorce and she was his wife at the time the pension was taken on and named on the documents - then it sounds as if she is entitled. I could be wrong - you would have to ask your own solicitor or the pension company.
