Went into the CAB on Monday.

They said my IB will be continued to be paid until I was asessed.

They also said I would be put onto contributions based ESA; because of my health problems as I have a heart condition and other issues including bipolar, I should technically be placed into the support group.

My partner's earnings will only be taken into account if I get placed onto income based ESA.

My partner earns around £27K a year, but that does include overtime, so if the overtime stops his income would fall.

I've got to go back next week to fill the form in which I get confused so they have said that they will fill the form in for me.

I just find the whole thing stressful, and confusing!!

This is correct...although obviously I couldn't say from details here as to what group of ESA you should qualify for. It's important to state that benefits are not awarded based on what you think you need to live on.. so the letter you said you might write above would be pointless. Regarding income related ESA.. which if you were to end up in WRAG (rather than Support group) you would be means tested for (they look at income, savings, partner) after 12 months I would say you are extremely unlikely to get any payments for given the circumstances you report here. I would therefore take the view that if you get placed in the WRAG following transfer from IB that you consider the chances of success of appealling a WRAG decision. If you get placed in the Support Group then the issue won't arise at least until next reassessment (reassessments are typically between every 6 and 24 months).

Good luck! Oh.. and if CAB are helping you with the form.. the ESA50 form... I'd advise taking any medical related documents you have along to the appointment in case some of it could be useful in supporting your claim... and helping the CAB rep fill in the form.

It has always been that we keep our finances separate; we dont have joint bank accounts, and I am not on the deeds or mortgage of the property.

My partner would not financially support me because he pays the mortgage which is around £600 per month; all I know is that the mortgage takes up around half of his earnings so he could not support me anyway.

My GP says all I could do is part time work of around 8 hours a week; I have been applying for part time jobs but no avail.

My friend had her benefit stopped when she attended a medical, even though she had been in a mental health hospital with depression they said she was fit for work!!
You need to be talking to the partner again, because if he's on £27,000 a year, £600 mortgage a month isn't half of what he gets a month.

If he isn't prepared to support you in any way at all, why be with him? Aren't partners supposed to help each other out with money?

According to a PAYE calculator, this is around £1740 per month but he might perhaps pay into a pension, so his mortgage is around a third of his net income.

And she's on £800 a month as well, not money to be sneezed at. I would imagine it would be hard for her to find a job that would pay that much.

My health problems are that I was born with a heart condition, have an under active thyroid, and I suffer from dysponea which is a form of bipolar.

I can include letters from the hospital going back to 2001 showing I had some tests done on my heart through an ECG which also picked up I had sinus tachycardia. which should help my claim.
  • MUMZ, none of your conditions will entitle you to employment support allowance. People with your conditions do work full time, though I've never heard of dysponea and google doesn't recognise it but I know people with heart condtions and bipolar and thyroid problems who all work successfully. Therefore rather than concentrating on your diagnosis's and the conditions you have when you are assessed for ESA you need to explain how you are affected by them and explain what you can and can't do. That is what is important as the assessment only looks at what you are able to do, and not why if that makes sense.

  • I suspect she means dyspnea, ie shortness, or perceived, shortness of breath.

I thought that to start with, but she says it's a form of bipolar?!

  • Is this a wind up ?

If not and you want to be independent then get a job. Living on benefits is welfare dependency.
