jsa advice pls

hi im looking for advice for my husband ,2 yrs ago he was paid off work due to ill health ,he has always worked before that
i work parttime as i have disabilty and get working tax credits ,my husband has never claimed any benefits when he was paid off ,we lived on my wages and working tax credits
he now ready and fit to return to work but friend said he should get JSA until he gets offerd a job? is this rite? any advice be welcome ,thank u

    It is questionable if he would meet the contribution conditions for JSA, if he has last worked 2 years ago.
    The relevant benefit years for a claim now would be 2009/10 and 2010/11.

    If he worked significantly from April 2010 till when he stopped work, then he may have a claim for contributions based JSA.
    I do not fully understand these conditions.
    This would not be affected by your income.
    (but your tax credits might be affected by his JSA)

    He would probably not qualify for income-related JSA, due to your income.
    However, if he was to claim this, he would be paid NI credits, which will help towards his pension, if he doesn't have his 300 years.

    Based on what you have said, he will not qualify for JSA (income based) as you work (assuming you earn over £105 a week). If its less than that he might qualify for some monies, but only to make it up to £105.

    He wont qualify for contributions based JSA as he has not paid tax in the last 2 years.

    If he claimed JSA C now ( i.e. before January 2013)
    tax years 09/10 & 10/11 will be used

    The only way to find out if he will get it would be to put in a claim.

    But if he worked up to November 2010 he would be in with a strong chance of getting JSA C, If he finished work before Novemeber 2010 he would have a strong chance of failing the JSA C conditions.

    Just make the claim and find out.

    Of course he should have been claiming ESA C all of this time
