I basically agree. The TV licence is transferred. But Council Tax water and the rest are not transferred. They are opened and closed. So open them at the new property on the day of moving in and close them on the old property on the day of moving out.TV Licence - no problem, you've told them your new address and your current licence will "simply follow" you.
Council Tax, water and anything else - I'd tell them you moved out on the first date that you no longer had exclusive occupation - the 22nd at a guess, as that's the first time you realised that the new tenant was already moving in. hey everyone
Just an update on this. The LL sent me a text - in response to my email no doubt - saying 'we will sort when we get back' (from his hol).
We went on Saturday to get the rest of our stuff in there - we knocked on in case the tenant was in, and lo and behold, she has moved in fully.
Me and OH are thinking we should pay up till Tuesday (yesterday) and we should get our full deposit back.:j:jOur gorgeous baby boy born 2nd May 2011 - 12 days overdue!!:j:j0 -
raaaaaah it gets better! It turns out our deposit is not registered with any TDS, but its in the safety deposit box at the post office he owns. Any ideas on this?:j:jOur gorgeous baby boy born 2nd May 2011 - 12 days overdue!!:j:j0

I would still dispute that transferring account on the 11th, was not the correct procedure! Both properties could have run their accounts in OP's name, until tenancy ended.
Maybe, but imo that still does not constitute an offer to surrender earlier that notice to quit.
If anything that could be seen as an attempt to scam the landlord out of utilities.Any ideas on this?
Well, you may have to sue to get deposit back if LL causes trouble.
You can also use the fact the deposit protection is a legal obligation and that LL may be liable to pay you a penalty up to 3x deposit amount for failing to comply in your negotiations with him/agent.0 -

Assuming you are in England? See SHelter info - scroll about half way down the page to Penalties when a deposit is not protected or is protected late

yes we're in England.
JJLandlord - in response to your comment about scamming the landlord out of utilities, it was agreed between us and LL to have the utilities and everything transferred into the name of 'The Occupier' on the date we moved out (11 Aug) till 6th September and we were to pay any outstanding bills.
