Ignoring the consumer rights and focusing on the lost data, try the freeware program PhotoRec, contained within Testdisk http://www.cgsecurity.org/wiki/TestDisk - I've used it for photograph recovery in the past and it seems good. Obviously it depends on the nature of the disk failure but it might get something back for you.0

Unfortunately the data can be corrupted or overwritten once deleted and can't be recovered properly on most of the consumer based programs. There is software that can go further down the lairs of data but it is very expensive and is the software the police and the commercial companies use. Sometimes it's best to just use a commercial service on a no recovery no fee basis, if they succeed it can cost about £100 though so even one offs can be expensive.0

I dont think PayPal offer protection for electronic purchases
Quite correct, they don't.
However, it's probably worth having a go making a claim through them.
A couple of months ago I purchased a 12 month, three map update from TomTom which was a download paid through Paypal.
The download didn't work and messed up my device to a condition Tomtom couldn't rectify to which the answer was -tough!:( (I'd only purchased a licence).
I made a claim through Paypal in spite of them not including electronic delivery and after the required time and TomTom not disputing the claim I was refunded.
About a month later TomTom sent an e-mail advising that I would no longer be entitled to download the map updates because I'd cancelled the order.
At least the refund went some way to paying for a replacement sat-nav.:)0
