Chemist Direct refusing to refund

I bought an item online from Chemist Direct. The day it arrived I changed my mind and immediately emailed them to cancel, requesting a refund. Their reply was that, because I'd opened the packaging, they can't accept a return and/or issue me a refund:eek:!
I know this is absurd and completely unlawful and I'm currently pursuing it. Just thought I'd put this out there to warn others.

There is no specific exemption in the DSR's for medicinal products, although it's possible that they may come under the category of goods:
which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.
The OFT guidelines on the reg's do state that there is no requirement for returned goods being able to be resold, so I can't see any reason why medicine wouldn't be allowed to be returned, unless of course it is a prescription product may then class as a customised or made to order item.0 -

Their returns policy does breech the Distance selling regulations a couple of times.In addition products of a medicinal, cosmetic or personal nature cannot be returned due to reasons of hygiene. We will not refund your order unless the item/(s) are in saleable condition upon return.
The OFT are very specific about this and have stated in all of their guides (for both consumers and businesses) that the ability to resell the goods is not a consideration when they are returned, and the hygiene aspect only applies to goods that fall into one of the exempt categories.Items that raise health and safety concerns
