Overpaid tax

I hope some of you can advise . I found out at the beginning of this year I have been paying tax as if I was receiving incapacity benefit since 2001. HMRC have refunded back to 2007 but are refusing to pay out before that . I have spoken to a lawyer who advised if I am unsuccessful I can try to go for damages to the DWP who are supposed to inform the HMRC when someone stops receiving benefits . My first attempt at official complaint has returned negative .

I could have helped by telling you who to write to. About how HMRC works. About how to push them for further repayment after admitting fault. About how they would make you pay if you underpaid tax.
But feeling "prickly" today, so no help for you.
