two limited companies same director

Just a quick question. If there are two limited companies and they have same director and one company goes under.
Can the staff be transferred across to the new company with no redundancy payments being made?

As a TUPE - yes. Same as any other TUPE between companies. Who the directyor is doesn't matter.0

No. The company is the legal entity - it has nothing to do with the director. Just make sure that you are TUPE'd - same conditions same continuous service. And be wary - dodgy directors do this sort of thing all the time.0
