Item not delivered only realised 3 months later!

Hi, I think I know the answer to this but figured I would add a post and see what response I got. And its helping me let off steam.

I bought something in May on ebay and I paid for it promptly and it was sent to me promptly. The seller seemed nice and genuine. I don't often use ebay and a lot has been going on in life which made me completely forget about the purchase.

I went into my ebay account today to buy something else and saw my last purchase and that made me realise this was never actually received. I contacted the buyer and was apologetic and admitted my stupidness! (its not often I do that) and asked what we could do. The seller just said it was out of her control now as the purchase was over 90 days old and she could not claim a refund from the post office. Ebay will also not allow me to raise a dispute because its over 80 days old and paypal will only allow a dispute to be raised within 45 days.

My questions is have I lost all my rights to recompense on this purchase? I did ask the seller if she was willing to refund half of the cost as a goodwill gesture but she just confirmed that 'it was outside of her control' since when was good will outside of anyones control?

    Possibly, I am always more concerned though with the 'post and run' people so before going into any long responses it is probably best to see if OP actually comes back.

    OP, what sort of value are we talking about ?

    I consider myself a real push over as a seller, but would not give you anything here for goodwill and would probably defend any legal action as well on the basis the claim was unreasonable.

    I have refunded an item not receivied buyer after about 4 months. Your only option would be small claims court, you have 6 years to do that I think.
