Lost personal Data

Not sure if this is right place to post

I applied to my local hospital for a copy of my medial records received the confimration then an invoice paid the £50 then nothing. when i called them said had been sent out three weeks ago by recorded delivery she gave me the tracking number nothing showing went local sorting office no letters.

Spoke with hospital going to re do then i will collect but they do not seem that bothered that my records have gone missing when i asked what they had done to try and find said nothing who should i be complaining to about this as thin k its a serious breach surely they should have sent next day delivery which is easier to track

    Why did you pay £50? If it was a subject access request under the Data Protection Act, the maximum fee is £10.

    Yes, you can complain. However, if they have actually lost your records, I can't see that the ICO is going to do too much about it.

    To be fair, if royalmail loose the records there isn't really much they can do to control this.

    If they have sent them out by post, and they have gone missing, there really is nothing they can do to try to find out where they are. Royal Mail won't do anything until 15 working days have passed, and even then all they will do is refund the postage. Chances are it will be returned to sender in a couple of weeks time.

    Arguable such documents should not be sent by recorded delivery as it is rather unreliable and isn't treated any differently to normal post. Special Delivery is probably the service they should use, but that is more expensive and besides isn't going to help you.

    If they are giving you another copy, I don't really see what more they can do.

    I'm guessing that they would have sent a copy rather than the originals.
  • I paid £50 as this is how much they charge and they are allowed to charge
