Tenant not paying rent(scotland)

:mad: Help Tenant not paid for 6 months (Scotland) can I go to small claims court. They will not answer my requests to talk or call. Turned up at door and they would not speak to me!

    I don't know if things are so different in Scotland but in England you could go to court when tenants are 2 months in arrears.

    Have you a signed AT5 form ?

    Are you a registered landlord ? It's the law for all LL in Scotland

    Did you credit check the tenant(s)


    Six months is a long time ! I think you have no chance of being paid, your priority must be to get your property back, before it's totally wrecked ! there are grounds for repossession, go that route, seek legal advice NOW. A tenant must be in arrears for 3 months to repossess, but is much safer with a AT5 in force.

    What type of lease do they have? Get yourself along to see a solicitor as soon as possible to start the process.
    Or phone me and I'll send the "boys" along. ;-) ( only joking)

    I am in Edinburgh and had this exact problem which I have just finally got sorted. The lease is the key. But even if there isn't one you need to instruct a solicitor to get the process started. It takes AGES....so the "boys" are the best option. ;-)
