When Does Negligence Transform into Theft

  • Whist I am packing I miss the item coming up on the display! I had checked the price and I TRUST that they have got it right - however, I am a victim of their incompetence to correct their computer. Why is it irrelevant?

Do what the current Ms Sonny does, checks every item throughy, it upsets those behind. Packing can come later.

Most weeks it is nothing, but occassionally, the supervisor is summoned and a discount given on the spot.

What, you think the likes of Tesco only have one computer?

When I say computer I mean one stock system, otherwise the shelves would be empty. To run any warehouse (which all shops are) you must know what has gone out the front door to know what has to be ordered to come though the back door. At the same time you must know what each till takes for 100’s of reasons; the main one is how much VAT you have to pay the government , if not they will close you down.

  • BPS v Boots the Cash Chemist - in a nutshell this case says that a shop is not bound to sell at the price on the shelf edge label. Someone further up already went into this (invitation to treat, offer, acceptance etc).

I don't see what further debate there is here?

Watch out for the reduced items at Aldi not going through as reduced Ive had quite a few of these - but when pressed for time etc its easy to get caught.

The only issues that would arise here is if they was deliberately misleading the public... there are rules & regulations when it comes to advertising. TS wouldn't be interested if a price was accidently mis-priced, however, if it was mis-priced deliberately or if they had known of the issue but chose not to rectify it they could be falling foul of the rules.

The points are, misleading prices wasting peoples time or tricking them into spending more than they thought.

Actually I think it is wilful, as it a computer that holds the price shown at the check out, and it the same computer that prints the shelf tickets.

More accurately, it is a question of having 1 database. For pricing, they need just 1 database. Any more is inviting problems such as shelf tickets and tills disagreeing. Yes, they will have backups and fall backs, but these should be seamlessly integrated and be one coherent database

Fraud and Theft require dishonesty - both would be impossible to prove at a large supermarket.

There are strict liability offences for pricing errors. Strict liability means that you do not have to show intent - so being negligent can lead to an offence. But in order to stop peopel committing offences left right and centre, strict liability offences often have a lot of hurdles to get over as wel las statutory defences. So again, proving an offence against a big store is difficult.

From my experience with a fairly large retailer you are living in a dreamworld with those ideas ........ then add in the (totally disinterested) human factor and there is a major c0ck up waiting to happen :o
