Seller refusing to refund!

Hi folks, I'd appreciate some advice on this one please.

Long story short, I bought a mobile phone from EBay, when it eventually arrived, it was faulty (randomly freezing, to the point where I had to keep take the battery out to reboot it) I contacted the seller, who said it was a software problem, and he emailed me a link to do a software update, which I did, but made the problem worse.
So I emailed him back, and said the problem is getting worse, and I wanted to return it to get a full refund. The seller (reluctantly) gave me his address to return
it, which I did, Special Delivery, and I have confirmation it has been received, and seller has acknowledged receiving it. A few days passed, I heard nothing, so emailed to find out where my refund is. Seller comes back to me saying that although the phone was freezing, he has fixed it, and will send it back to me as he "doesn't do refunds"
Now, I've told him I don't want the phone back, as I don't want to be in the same position again, and also since returning the item, I've bought another handset.
The seller is flat refusing to refund me, even though he has the phone, and my money. I have raised a SNAD case since returning the phone, but I have to now wait 8 days to escalate it. I realise I should have raised the case when the problem started, but as the seller accepted the return I didn't think there would be any need to.
Do you think it would be worth contacting my bank to see if they can do anything?. I paid with my credit card through PayPal. Or do you think I should just wait the 8 days and escalate it? Thanks

    I'd wait the 8 days (although it will feel like a month!) - you'll get your refund. Then it's a big fat neg.

    In the meantime, keep your Special Delivery receipt safe!

    Definitely don't do anything until your ebay case has been finished. Make sure they know it has been returned and you have full tracking.
