Thanks again. Actually it is not all that tall, we are only talking a tree which is about 8ft so pretty small as trees go. The problem is that we are on a hill and their house is at a lower level so for them it is high. It has been left for quite a while on their side I think, my husband thinks that it will need a chainsaw to cut the branches.
Thanks again for all of your input, I think it is now just a case of making a decision about whether or not to contribute to whatever they decide to do.

as stated already you dont have to do it, but personally i cannot understand why the law is like this.
Its your tree and its over someone elses boundary so i think you should be responsible for it.. Why should someone else be responsible for maintaining something that is not owned by them.0
