If they think any of the T&C are unfair to the consumer then they will rule against it and make it unenforceable so the fact that you (as a consumer) agreed to it doesn't matter

Unfair IMO, but what can I do - I've agreed to the contract.
I have no bike, so I cancel my insurance yet I still owe the remainder of my premium and have paid a cancellation fee to Swinton also.
Split milk on a number of counts:
You had a claim which they paid out on.
You didn't read or understand your policy.
You cancelled the policy but didn't read up in the policy what that would entail as far as the broker's charge would be.
But alwAys worth raising an official complaint as it will be cheaper for them to give you the £40 back than get involved in correspondence arguing with you. (And it won't cost you anything to keep escalating the complaint!)0 -

I'm talking about getting a refund on the services you haven't used i.e. the remaining time on your policy.
On a supermarket analogy, if a supermarket allowed you to return goods for a refund then if I bought 12 cans of beans and used one of them I would expect to be able to get a refund on the remaining 110 -

He has used the policy though. He claimed (well the TP did). That is what insurance is for to cover you in the event of a claim doesn't matter if that claim is on day 1 or the last day. Once you have had a claim you have cost the company money sometime more than what you have paid. Why should you get a refund on this?
Also most companies will allow you to change the vehicle following a claim so no need to cancel. There is no remaining time. It s a block of 12 months and if you claim in that period then you dont get a refund. Its irrelevant really what we all think as the FOS position is published. There is no remaining time?If I take out a policy and then after one month has gone I still have 11 months of cover remaining.
That 11 months of cover has a value representing the risk to the insurer of more claims arising during the 11 months.

So you think it is fair for you to pay say £260 on your insurance claim for say £900 and then get a refund??
It is standard practice for all insurance companies that if you claim you don't get a refund unless it is non-fault. You've caused the accident why should the insurance company lose out because of you.
As for you bean comment. Of course you would get a refund on the 11 you haven't used. You wouldn't get a refund on the one you have used though would you?
