Who are you speaking to at the old employers? What did they say when you told them what the reference said? You could get them to retract it by asking if they have consulted the wrong personnel file and request that they reissue it to the new new employer before going down the legal route.If you haven't got it - please don't flaunt it. i have been speaking to the HR department- the new employer had spoke to the manager that provided the reference and the senior worker as they were so surprised by the poor reference as i had worked there for so long- i dont think they could re-tract it.
i had already started the new position.0 -

no, they stopped replying to my e-mails and i requested receipts for when they opened the e-mails so it looks like they are not even opening the e-mails now!0

Doesn't follow. You can set most software to either ignore receipt requests or to ask before sending.
In such disputes it is best to write. The normal legal presumption is that mail is delivered so if you have a certificate of posting that is all you need.0 -

no, i did not know what it said till today.....i had asked them for a copy and they said that they would speak to the manager, i do not answer my emails so i wrote to the last tuesday and i am awaiting a response!0
