Chapter 3 of The CPRs An Overview
3.4 A commercial practice is unfair if:
• it is not professionally diligent, and
• it materially distorts, or is likely to materially distort,
the economic behaviour of the average consumer.
Essentially, for the general prohibition to apply, the trader’s
practice must be unacceptable when measured against an
objective standard and must also have (or be likely to have) an
effect on the economic behaviour of the average consumer.
The second condition is likely to be met if, for example,
because of the practice, the average consumer would buy a
product they would not otherwise have bought, or would not
exercise cancellation rights when otherwise they would have
done so.0 -
Good info - thanks
Moving Provider:
Just to remind anyone who does not want to keep their broadband with these miss sellers that the Plusnet half price for a year deal ends on 26/10 - which was the best I could find. (depending on your circumstances and your needs you may find better - ie already a sky customer etc, for me this was the best - or see useful post above for other deals)
I am not in a 'cheap' area as my exchange uses adsl max, the cost for me is 18 for first 3 months and then 21 for the following 9 months - on a monthly contract - with 60GB allowance and EW calls, line rental, VAT included.
As I mentioned I have already moved my broadband, after only having one previous ISP (freeserve wanadoo orange) to Plusnet and I can tell you this after a couple of weeks: The move took 6 working days via a MAC code, I was not without internet for more than 40 seconds! I got an email from Plusnet saying service was active whilst still connected to Orange, logged into my router and changed user and password to plusnet, net disconnected and reconnected to plusnet. Its connected at the same rate as before with both upload and download speeds, on btspeedtest all is the same, on router stats all is the same - noise margin etc. However there is one difference: web pages now open quicker, the nets a bit 'slicker' on looking into why a tracert shows less hops to a location than under Orange, I think its also to do with improved DNS. So I have had no inconvenience and am happy with the connectivity, the English call center, and the web site - very promising.
Still fighting for the termination of my mobile contract at no cost to myself due to Orange miss selling; I do now feel that i need compensating for my wasted hours on the phone to them, the emails i have wrote to them and ofcom etc.0 -

I have been through most of what others have experienced, and at the end of the day I have given up trying to fight Orange. They have become a disgusting company to deal with when there are any problems. The Exec Office are not Executives in any sense of the word, they are there to fend off complaints and waste people's time.
I think I have had "the phone call" which I believe was from an outside company acting for Orange. The man asked if there was anything he could do to keep my custom, I replied that it depended on what he could do... and he authorised my MAC code. End of story.
Then I got the letter others have had from Rotherham, saying that they had special offers for me. I rang and got through to someone I couldn't understand in the Czech Republic. I asked to be put through to the Rotherham call centre, and he said he would do this, and I was connected to a young lady who was British. I asked if she was in Rotherham, she said "no but I'm from the UK". I explained why I preferred to get through to Rotherham and she said she could tell me what the special offers were - £14 line rental and broadband etc etc.
I said that this wasn't special, it was what I had already turned down.
She replied that was all the special offers I was getting whoever I spoke to, and hung up on me. Cheered me up no end !
I have now wasted more than enough time. Absolute pathetic company.0 -
cryptic1, that is Oranges plan, rang twice today first time kept me hanging on for around 20 mins no intention of passing me to anyone, second time passing me all around to different departments. Orange are thinking after time it will go quiet, one friendly chap said 50% of free customers have either taken the offer or moved their broadband elsewhere. They are banking on a few of us being left by the end of October/November and give them some weak offer.0

Well unless you have logged a complaint with Ofcom and not just requested your MAC code then im guessing you haven't been called by the Santa Clause team.0 -
Spoke to the Exec office today which it isn't IMHO, its actually the mobile dept she said, resolutions coming this Friday she said, if you have no case number no phone call.0
