Faulty sofa after 4 yrs

after a little advice

in 2008 i paid £1375.00 for a two piece Leather suite from SCS this was a replacement sofa as the first one was faulty and they discontinued due to the fault.

The sofa has a 12 month waurantee with it, in addition we also purchased accidental damage cover ontop of this price

the arms on both sofas appear faulty, they have lost the cushioning and you can clearly see through the sofa the outline of the wooden base, also the larger of the sofas "gives" when you sit on it

i have been into the store today and asked for someone to visit and look at the sofa as im not happy with the condition of the sofa and dont feel that the places where the "stuffing" is missing is not in a usual place, ie. where you would grab the arms to get up.

they have told me that i havent a leg to stand on as the sofa only had a 12 month warantee of parts & labour and any manufacturing fault would have shown up in the first year.

i dont feel that this is fair after paying 1375 for a sofa i would expect it to last a good few years!

have i any legal consumer rights or do i just accept?

    Why not read MSE's Consumer Rights article?

    In there you will find that you have up to six years (in England and Wales) to claim a remedy from the seller.

    You will almost certainly find that SCS will expect you to prove that the thing is inherently faulty... i.e. that the goods were faulty at the time of sale but not necessarily apparent at that time.

    Anyway, read that article and feel free to ask further questions.

    Noting you can pursue a claim up to six years doesn't mean you have a valid claim. What you would need to consider is the products expected life span.. I suspect when pursuing a claim under SoGA they would refund around the £200 mark.
