Handing in notice - can they counter serve?

Hi,
I need to hand in my notice tomorrow. However I am still in my probationary period. I have to give them a month, (and I want to work it). I am able to do my day to day job, and the only systems I still need training on are ones that I don't use.
However as I am still on my probationary period, and my continuous service is 'one month or more, but less than two years' the minimum notice I can be given is one week......
After I hand in my 1 months notice can they turn around and give me one weeks notice?
I just want to be prepared.

Are you sure your contractual notice is one week, bit mean for them to make you give month and them statutory.
Whats the policy been in the past might be better to wait if they have a history of terminating early.

According the the documents they had me sign thy can technically give me a week - I just don't know if they can serve me after I have served them....
I do have approximately a week to take - but the leave chart is full so I don't know how that will work...
I've only been there a few months so I don't know what they normally do. One supervisor handed in her notice, and left that day but she was still training, and I don't know if that was her choice or theirs....

According the the documents they had me sign thy can technically give me a week - I just don't know if they can serve me after I have served them.... Do check that there isn't parity of notice. It is not unlawful but it is unusual for an employer to require greater notice from the employee. Are there different requirements during the probationary period than for afterwards?
I do have approximately a week to take - but the leave chart is full so I don't know how that will work... If you have accrued but not taken holiday at the time of termination of your employment they will have to pay you. If they do have the right to give you just one week's notice they can also require you to take leave in that period - but they have to give you twice as much notice as the holiday to be taken. (There are ways round this but they'd still have to pay you for some of the holiday as they would not have sufficient time to make you take all of your accrued leave during one week.) They could also require you to take the holiday during your one month notice period and then there would be no extra holiday pay due when you leave. What they do depends on how much work they want to get out of you.

Thanks I suppose I need to write the letter now....
I'm not looking forward to handing it over, as I kind of figure I should do it at the start of my shift.

Woo hoo- they were lovely about it...
Handed in two letters to people who were off, so I gave one of them to the manager in today (she's not my team leader) and she was really sweet.
They haven't counter served me, and she said she would text my line manager (which i think is a bit mean on a day of AL but hey)....

Most of the employers on here will accept that not every job is for you (I know that I certainly do)
Obviously, if at all possible and you haven't found something else, you should try and find something else within the company, but it's often in both employers and employees notice to wait a month, especially if the company is busy.
