New items bought from eBay seller is broken

I have new 700 GB HDD bought New items bought from eBay seller. It is broken already (drive is not recognizable by PC) but still within one year manufacturer warranty. How to deal with ?
Do I need to contact the vendor ? or
o I need to send it to Toshiba, the problem with this, I do not know where to send it, I do not remember having the address.
I will appreciate any advice

I'd try deal with MFR first. They may know based on the serial number it's still in warranty without a receipt, and may offer a better service than the ebayer.Wanted a job, now have one. :beer:0
