CSA and Debt Collecting Agencies

I have been told by the CSA that as my ex-h hasn't paid maint (for nearly the past 7 years) that in Sep 06 his arrears was passed to a debt collecting agency.

The CSA also told me that they have no legal right to chase the DCA and the DCa do not have to update them on the progress of getting money. Basically I have to sit and wait for some money via the DCA to the CSA to me.

Also - becuase the arrears have been passed to a DCA - the CSA can no longer collect payments from my ex-h. Anything else that is owing will have to come through the DCA

It seems I could be waiting another 7 years for any money!!! Has anybody else had experiences like this???:confused:

    This is all very new. If it were me, I would go to my MP and demand to know what is going on. It is totally unfair for them to leave PWCs in the lurch like this with no knowledge of what is going on. I personally believe it is a basic right to know if a debt owed to me is going to be paid and when and what aciton is being taken to get it!!!!!

    Did you get told by the CSA that the enforcers would get in touch with you ?
    This is what I,ve been told and I,m now inclined to not believe it .

    gypsyjanet - do you know if the enforcers in your case are the debt collection agency or the enforcement team of the CSA? you need to establish this.

    I'm not surprised! I gave the CSA my ex's car details, registration number, make and model including colour, stated exactly where he parks his car in the evening - outside his house yet they never went for it! Sent the cert back nula bona (or whatever it's called!!!) I don't think they ever even went there!

    UPDATE!!! Thanks sensemaya for suggesting Drakes
    I've rung them - and not much help because of the Date Protection Act.
    What they are saying is that any money collected for the CAS has been sent to them.

    Back to the CSA then!!

    Ok clarification needed DCA are legal and trade at the moment, drakes were the bayliffs used in the enforcement department.
    Unfortunately once a case has gone out to L&T there is no way of getting an update, there is no further information that can be passed out to you until we are sent money from L&T.
    I can understand your frustration in this but it is a new thing since last september, at the moment it is prooving succesful but there have been a shed load of cases sent to them so they are doing there best, and at the moment we can only apolgise for the delay but they are an effective way of dealing with debt.

    Steam, can you find out (if you don't already know) on what grounds they are saying that no update can be given? Surely the client who is owed the money is entitled to know what it happening and whether there is actually any possibility of getting any money? As a PWC (also staff) I would be absolutely fuming if I had to wait for years with no contact at all - I need to know what is happening and if I am going to get my money. Also, how long do they give it before referring it back to the CSA for alternative enforcement action if they fail (as they are bound to in some cases)? Thanks

    Yet another update!!

    Becuase of "a glitch in the system" the debt didn't go to DCA in Sep - it's going end of APril
    I have at least found out the DCA has 6 months to use all powers to collect or pass back to CSA
