straightforward paypal reclaim question

Hi.
a year or two ago I was looking for a laptop on ebay.
I bid but lost.
I then recived an offer to buy a laptop... i shoulda realised was suspicious back then, but it seemed to have come through ebay, but apparently was not, i later found out.
Anyways... I sent the money through paypal, & the laptop never turned up (it was £500)
Went through the paypal procedure to get my money back...
Anyways paypal some time ago made a final decision that i was due the money. & on my account it is all recorded officialy as my claim is valid & im owed the money.
Problem is that paypal cant get the money from this person who was obviously a fraud.
So... is there any way i can get the £500 back?
small claims court?
paypal must have some insurance policy to back them up. regardless of the terms & conditions.... ive been ruled as due the money!
shurely they have to have a department investigating it. will this department ever come up with the other persons registration details/ bank account the money was sent to?
couldnt the bank they registered with be responsible for allowing a fraudulent account to be created?
im prepared to have to push for my £500... so it is possible to get it back?

I think its too late to make any form of complaint now. If you had paid through paypal via a credit card you could do a credit card chargeback but it has to be initiated within the 90 day since the transaction I believe.a year or two ago
I've had to do this once on a low value item from ebay and got my money back no problems, thanks to fellow MSE'ers.ummm...0 -
I can't believe it's all taken so long (although you don't say how long ago you paid, or how long ago paypal decided in your favour)
If it really was years, I think your only hope is small claims. That said, action should really have been taken sooner, and I doubt your credit card people will help now.My TV is broken!

I just need to push paypal to get the money back.
I need to know the best way to do it.
Also... can i claim the £94.71 interest i worked out as well?
Heres the details...
The reason I ask now is cause of all the current hype about bank reclaims.. & pushing the banks for our money back....
I figure it about time I pushed paypal to turn up with my £542.50 mabe plus interest too.

Also I did also report it to the police at the time & was given a crime number ect, ect....
The case has been closed & the dispute on my profile is still open/unresolved.
Paypal say they are "working to recover my money" which could take forever!
Fact is... I want compensation/insurance NOW and they can work to recover it as long as they want there after.
Basicaly, my claims been granted. & I want my cash back. Now.

Small claims surely must now be your only option. You should have been pestering your credit card company two years ago.
The 'seller' will be long gone and if he hasn't put any money in his account in two years, he's not likely to now.
Edit having seen post above:
Paypal will only give your money back if the scammer puts money in his account. That's unlikely to happen. They did the best they could for you, considering you did an off ebay deal.
Your only chances now, imo:
- Get a result off the police
- Find some details for the seller (good luck with that as it was an off ebay deal) and take him to court.
Paypal will NOT refund you unless they a) have no choice or b) have reclaimed the money first. If you'd taken it up with your credit card people, they'd have had no choice. Option b is obviously out as paypal's attempts to get money off the guy have clearly got them nowhere.My TV is broken!

as long as paypal tried to get the money back , then they have kept to thier agreement. the fact that there were no money in the other account isnt paypal fault and by the looks of it the person hasnt had money in the account after that or paypal would of taken t to give back to you.
now you can take the person to court if you have thier details.
it doesnt cost that much to do.
there is only one problem through , even if the court decide in you favor , the court can not make the other person pay. even though you are awarded the amount.
but i think as you have left it so long i dont think there is that much hope for you seeing your money back .:)0 -

so how can i get the details off of paypal to file a small claim?
& if its fraudulent.. who am i claiming against? the fraudulent person? or their bank?
This scam artist even had the cheek to have the same email adddress as the ebay sellers profile name& i wouldnt be surprised if it was the same guy operating a scam alongside a legit buisness. shurely he musta got many complaints regarding the same fraudsters?
he was not helpfull at all, & really aggressive. I figure it was the ebay seller. Because if it wasnt & if the scammers were using his name, he would have reported it & also given details or been at least concerned someone was using his trade name in email.

You won't get the details from paypal. Normally when you buy through ebay you can request their contact details. As you don't have a transaction with that seller on ebay (are you positive it was the same person?) you can't do that.
Is the seller still active on ebay?My TV is broken!

you cant drive a car on the road without insurance, & shurely regardless of rules & regulations you shouldnt be able to send any ammount of money without some kind of insurance.

Paypal don't insure you. Ebay do to an extent, but you didn't buy through ebay.
Your credit card insures you, but that's no help now.My TV is broken!
