Do I have to wait?

Bought an item on the 6th. Not expensive. Only £6. It's not arrived yet. Contacted seller who asked me to call the local sorting office. I did. No luck. Now seller has asked me to wait till it's time for a royal mail claim. Then after the claim they'll refund. Told them I am happy to help with the claim but mot happy to wait that long for a refund. As I want the item.
Apparently that's what ebays t&c's say. So they can't refund.
Is that right? Or should I just file a claim for none recept with eBay? Just to add. It's a personalised item. PayPal tells me they don't cover you for those.

File a claim for INR. Any seller hoping to do continued business on ebay should know that buyers do NOT have to wait for Royal Mail to refund seller blah balh blah.0

I am not sure what action you want for an INR. Normally I would agree with Soolin and opt for PayPal.
But:
OP. PayPal buyer protection doesn't cover custom made goods. I have had the misfortune to have had two disputes for custom items, one PayPal refused to cover one they allowed. Both INR. So it would seem they don't know their own policy. However their policy in section 13.3 clearly says they don't cover custom made goods for any dispute (why they exclude them for INR doesn't make sense to me but it is there in black and white).
On this occasion there would seem to be a greater hope of a resolution in your favour with an EBay dispute as they do not have such a clause*. Open it and try to escalate it as soon as you can.
* I haven't noted this anomaly before, so may be one worth remembering, much like the dispute process for fakes.0 -

No I agree, INR doesn't make a dot of difference if it's custom built or not. However, their policy is worded for INR and SNAD, which is crazy.
Having fallen foul, I would err on the side of caution and go via Ebay.0 -

Files with eBay. Got a slightly annoyed email from the seller who then refunded next day.
Not sure what feedback to leave. Don't know I'd the seller was new to the process and genuinely didn't think they had to refund until afte the RM claim. Or they were just putting it off.Sigless0
