Barclays PPI Refusal

We were told we could not reclaim our mis-sold PPI and could not take our case to the ombudsman as the date of the sale was before they became signatories to the General Insurance Standards Council Code of Practice we had the policy against our mortgage from Dec 1996 until March 2002 is there anything else we can do ?

Ring the FOS and ask thier advice on whether you can persue it any further.
However you will need VERY good reasons for claiming missell on mortgage PPI.

I suggest you e-mail a copy of the response to consumer.queries@fsa.gov.uk and ask that they investigate as Barclays are misleading you by suggesting misleading you because they were a member of the Banking Ombudsman scheme at the time and therefore you CAN go to FOS.
You can then go to FOS anyway. Whether it will help or not is a moot point because:
1) The policy may not have been sold by Barclays in the first place.
2) It may have been a condition of the loan (that was sometimes the case then.
3) You have given no evidence to suggest it was not suitable for you.0 -
Hi we did give evidence as we were told we had to have it even though I was (although employed at the time) a director of my own company for which Barclays had our business accounts and was self employed from Dec 1999 we did not have the policy details but we had bank statements showing payments made by direct debit thay also said they couldny retrieve any details of PPI charges made to our account0

In the 90s, the banks did have mortgage deals that insisted on insurance. If that is the case for you then there is no wrong doing. Packaged deals like that were allowed. The wrongdoing is where they tell you that you have to have it but you dont. Although that is notoriously difficult to prove.we had bank statements showing payments made by direct debit

Hi I have now spoken to the FOS who have advised me that I have a case to be answered and that they should not have told me that I could not take my complaint to the FOS so we shall see what happens but thanks to all who have replied to me0

They always say that even on cases that have no hope in hell. However, the fact you have the right to refer to them is correct. Just dont get your hopes up yet at what you were told on the phone. The phone is not manned by those that are qualified or experienced in financial services and are not adjudicators or ombudsman.I am an Independent Financial Adviser (IFA).
