Car claim everything going wrong!!

Hi everyone hope someone can help.

My wife had an accident with a white van man(WVM) that hit her from behind, he accepted it was his fault and she got his details. It was a little bump but enough to crush the back bumper and messed the boot lock up all.

She rang her car insurance company Quinn Direct and informed them about the accident and she decided to put her claim through them(looking through the forum this may have not been the best thing to do!) she then had a courtesy car sent out as she needs a car for business use as she is a social worker and is on road and taking kids out in her car. So a rental car was sent out and her car taken away. After a week Quinn came back and said the TP have admitted liabilty and the car is being fixed..week went by Quinn said it had been fixed and was waiting for the TP to just come and check the car.
Another week later Quinn turn around and say they are having problems who to claim of and the WVM car was a business rental car and not sure who to claim off OR EVEN IF HE WAS INSURED AT THAT TIME! the latter we got told this week after 4 weeks of this going on! :mad:

So we are still trying to figure who to claim against and the car rental now want their car back and going to leave me with no car! the car hire bill has now gone to about £2000! Also i have been told by Quinn I can't claim through MIB because i am fully comp, and i don't want to claim against my insurance!

We are trying to figure who to blame in all of this and how we can get this resolved! It seems if Quinn Direct did their job properly I wouldn't be in this mess. Can i take my accident claim to someone else now maybe someone thats actually going to get to the bottom of the TP insurance? or to a solicitor?


Any help would be appreciated as i have no idea how to get this resolved and my wife's car fixed:A

    Need to get some bits straight here.... firstly it sounds like you had a credit hire car rather than a courtesy car that you first said.

    Why was the Third Party (or did you mean the TPI - Third Party's Insurer) inspecting your vehicle after it was fixed?

    If the car is fixed why hasnt it been returned to you and why are you still in the credit hire car?

    Who authorised the garage to do the repairs Quinn or the TPI?

    Who exactly admitted liability to Quinn, the TPI or the TP themselves?

    meant Third party insurer.

    They said it was fixed but Quinn Direct have now turned around and said we haven't fixed it because they are not sure who is liable to pay for the damage as they are saying the other party insurance company are lingering on saying yes and no at the same time!!! now they have turned around and saed we are not sure if he was insured at that time of the accident and no one is now taking liability.

    Quinn authorised the repair or we heard it from Quinn, and im guessing they called a locally approved garage to come and take it away.

    Not sure who told Quinn they just does us they had admitted the liabilty and sent out the credit car hire.

    Given you are comprehensive and you have instructed your insurers to deal with it they are the ones that should have been repairing your vehicle and so the TPI wouldnt have ever seen it.

    By the sounds of it they have passed the lot to an accident management company (for a commission) and now that there are liability/ indemnity issues the axm doesnt want to be involved anymore.

    Your insurers should have paid for the repairs, excluding the excess, and then they look to recover their outlay from the TPI or if it is uninsured from the TP themselves (or potentially from the hire companies insurance but this would probably require court action to establish that they are the RTA insurers) If you have legal expenses then a solicitor would be instructed to recover your uninsured losses (eg excess) at the same time - though if it is just excess your insurers themselves may do it on your behalf.

    Sounds like you need to speak to your insurers - and make sure it is your insurers and not an accident management company that you speak to.

    You certainly need to speak to your insurers, there are potential issues if you've been driving around in credit hire whilst your car just sits in a garage when you have comprehensive insurance.

    Premiums would, in the long term, not change any more than they already will. If your policy renews whilst this is ongoing then they would probably but this should get reversed after its sorted.

    In certain circumstances an insurer can be forced to deal with a TP claim even if there are indemnity issues (eg insured car but a non named driver driving it). When they act in this capacity they are known as the RTA insurer. Some will do this immediately, others force you to go through the full legal process
