Chartis europe limited insurers

Disgruntled of Glasgow v CHARTIS EUROPE LIMITED
I am hoping to find other disgruntled people so we may bring a "Class Action" either to the attention of the Financial Ombudsman Service or in a court of Law against CHARTIS EUROPE LIMITED INSURERES"
On 24 February 2012 I hit a car in a petrol station. It was not my fault, a man with little or no spatial awareness parked at least 3 ft from the petrol pump, he saw me coming as you can see on the CCTV yet decided to fling his door wide open. I was enroute to another appointment however an extremely kind BP petrol pump attendant told me to return later in the day and lo and behold he gave me the footage which you can find on YOUTUBE under- "He parks 3ft from the pump."
It is now 16 August 2012 (8 days short of 6 months) My insurance company Endsleigh Insurance have tried unstintingly 2 to 3 times per week to get a resolution as have I. Together we have tried to contact CHARTIS at a conservative estimate between 80/90 times. I myself have spent at least 50 hrs chasing them writing emails, letters & making phonecalls. Once I actually got through to someone who told me "We do not take phonecalls from 3rd parties" apparently a newly implemented policy since April this year. My clain began in February !
The bump does not look big but there was damage to my car old as it is both external and internal from the shunt, It is my car and it gets me from A to B. Surely anyone in their right mind would say an insurance company that is even refusing to take phonecalls from other insurance companies! Is "Not Fit For Purpose" Are they not supposed to be working together to a) Get customers back on the road and keep them happy and b) To combat fraud? Both of which they CHARTIS have failed to do, as initially they even tried to claim against my insurers saying I was to blame for the accident, however they swiftly changed their minds and admitted liability once they had viewed the YOUTUBE footage yet they are still trying to dismiss my claim for compensation for all the time spent chasing for settlement, correspondence & comms cost. Do they think my time is not valuable. Who is to pay for "losses incurred" and my phone bills? They have picked on the wrong person to cross swords with. We the travelling public have had enough of these monolithic companies trying to trample all over us it started with the Banks and now the Insurance companies think they are a law unto themselves !

Problem 1 - you are not their customer
Problem 2 - they legally have no obligation to deal with you directly. Most insurers do chose to because in fault claims they can mitigate the money they payout/ get better deals with their suppliers etc but that is purely a commercial decision
What stage is your repairs at? Are you Comp or TPFT?0 -
I think you need to research what a class action is.
You have a duty to mitigate any losses and I can't help feeling you have spent far too much time on this. If your time is as valuable as you say, you have been wasting it unnecessarily.0 -
fair point but the duty to mitigate doesn't extend to just writing off your losses because the at fault insurers fails to respond.
OP, as pointed out above, you arn't a customer of Chartis, your remedy is against the other driver. Write a letter before action giving 14 days to settle and if you don't get the money then sue him.0 -
Of course, but 80-90 attempts at contact in 6 months? That's almost once every working day. No wonder Chartis can't get it resolved - the phone never stops ringing.fair point but the duty to mitigate doesn't extend to just writing off your losses because the at fault insurers fails to respond.0
