Company disposing of my property without consent?

Hi!

My very first post, my gf a regular user is very proud! Im still getting the hang of things so please bare with me!

I have been having major problems with an Online company that sell electronic cigerettes.
I purchased my "e-cig" from them in Februry 2012. I started getting faults with it in April 2012.
The warrenty they offer is only 28days. I sent the guy an e-mail who runs the website, asking if he could take a look at my battery and see if he could see what the issue was and if it could be fixed.
In fairness as I have stated the e-cigg was not in the companys warrenty so I wasnt expecting him to do it for free.
After receieving an e-mail from him telling me to send it to him to have a look I sent it.
I then didn't hear anything back from him for well over a week. I contacted him to ensure he had recieved my e-cigg. I got a reply shortly after saying "Sorry we recieved your e-cigg, we have tested it and its is faulty. This is not coverd under the warrenty".
I replied back to him, "Thank you for looking, could you send my battery back to me as I can still use it in a way"
I then didnt hear anything from the person dealing with it for another week. I contacted him again to ask if he had recieved my e-mail about sending my e-cigg back.
I shortly recieved another message to say "Sorry we dispose of no good battery's (e-ciggs) once we have tested them".

This has left me fuming, that the person has taken the assumption to dispose of my own property with out my consent. To the fact if he had checked my ecigg properly he would have seen it did still work in some way.

Im reading through what I have put above and am not sure it will make alot of sense to people! Ha!

In short, I sent a faulty item back to the company I purchased from, they have disposed of it after "testing" it without even contacting me???

I'm after abit of advice as to what I can do?

Ive contacted him and said I expect some compensation, he replied "You battery was broken, were sorry we disposed of your battery you can come and collect one from us that will be in a similar condition" < Collection - 147Miles from my house!

I really dont think what he has done is right. Does anyone have any help or advice? Someone has mentioned Trading Standards?

I hope that kind of makes sense. Ive been typing away getting pretty angry just thinking of the incompitence of this company!

    Join this site http://forum.nosmokingday.org.uk/ Cold turkey was the only method that worked for me fake cigs patches etc were just a constant reminder that I was trying to quit.

    So basically what i'm saying is forget the e-cig it's only stressing you out at a time you don't need to be stressed.

    Good luck in the quit it's certainly worth it.
    I think the surest sign that intelligent life exists elsewhere in the universe is that none of it has tried to contact us.
  • Thanks Guardsman. Yes your right the issue hasn't helped regarding quitting smoking. I've always just been pretty annoyed at wasting money. (an ex smoker can say that ;) )

    And his attitude has just irritated me further!

    Technically they shouldn't have disposed of the battery and gave you the chance to get it back, however you would now need to sue for the loss of a worthless battery. No point in worrying about it as it is useless anyway and would have cost you more to get back that it's worth.
    Just move on and don't buy from them again.

    In theory, they shouldn't have. But they may have charged you a fee to send it back to you.

    No. I sent the ecigg asking him to take a look. I heard nothing from him for two weeks, he then messaged me to say it was broken and he's disposed of it.

    I would have been fine paying postage to receive my item back. By the time he had contacted me he had disposed of it.

    His latest solution to fix this issue was to today send me a replacement battery in equal condition as the one i sent him. The one i received is in much worse condition than my one i sent.

    Im a pretty stubborn guy and really don't want to let this drop.
    They were not the cheapest thing to buy. And how idiotic the guy had acted has just made me want to gain what i rightly think I am compensated to.

    The battery you posted is very similar tom its a riva1100.

    You haven't been vaping for long have you?

    These things are generally classed as disposable with a limited lifespan, he had a look at it and it was faulty, so how could you use it?

    Pick your battles, this is one that is not worth the energy.

    Me and my gf have been vaping for over 7months now. Both of our other batterys are still in working order.

    I explained to guy i sent it to it was still useable in away.

    If you are familiar with the battery - cartomizers it was the cartomizers that stopped connecting to the battery.

    If held in place it would still work.

    My point I will still stick with is he should not have disposed of my battery without contacting me first. Regardless of the battery condition.

    I have so many bits here from ecigs that have died.

    The thing I have learned is you need to be able to cobble these things together with silver paper and rubber bands.

    Why not ask him for a discount voucher he might be willing to do that.
