Am currently having work carried out as part of insurance claim due to flat above having a leak.
Have been told that the re-decoration must be as before, ie blown vinyl and painted. Should I not get the choice of having patterned wallpaper if I so wish? Do I have to accept this?
Insured with Churchill and they are also trying to reclaim from flat above's insurers but don't know if this will be successful, meaning I lose my no claims bonus and have had to pay out the excess!

You are highly unlikely to be able to claim from the party above unless you can PROVE negligence - ie they knew about the problem and didnt do anything within a reasonable timescale to fix it. Their washing machine breaking down and flooding their flat and it coming down into yours (as a common one) wouldnt be negligence it would be bad luck for both of you.
Normally insurers will calculate the cost of repairs on a like for like basis (eg £1000) but ultimately dont care what you have done as long as it comes to or below the amount - especially if you use the same approved supplier. Alternatively you can get a cash settlement and spend it as you want but if it is £1000 for their approved repairer it is likely to be a 30% or more discount from the cash settlement to represent the discount they are receiving from their approved repairers.0 -
The insurer is required to put you home back to the condition it was before the incident (within claims limits). However I can't see that they would insist that you have painted over blown wallpaper as long as you can find an alternative for the same cost.0
