Article 1 – The Organizer

CLARINS, a Limited Company with a Board of Directors and Supervisory Board, with capital of 157 933 286 Euros, registered in the Nanterre Trade & Companies Register under no. 330 589 755 and with registered head offices located at 4 rue Berteaux Dumas - 92200 Neuilly sur Seine, France (hereinafter the “Organizer”) is organizing a free draw without obligation to purchase between 1 August and 20 August 2012, entitled The Clarins Summer Draw (hereinafter the “Draw”).

Participation in the Draw implies unconditional acceptance by the participant of the present Rules and the principle of the Draw. Any person breaching one or more of the articles of these Rules will not be allowed to participate in the Draw and shall be denied any prize they may have won.
No written, oral or telephone request regarding the Draw, the interpretation or application of these Rules will be answered.


Article 2 - Details of the Draw

The concept of the Draw involves participants completing the entry form, filling in the following compulsory fields.

• Title
• Last name
• First name
• Email

After 20 August 2012, the Organizer shall draw the winner(s) under the supervision of a Bailiff.

Participation is exclusively via the following address, as from 1 August 2012: https://www.clarins.co.uk .

The Draw is open to all residents of the UK and Northern Ireland aged over 18, with the exception of employees of the Organizing Companies and residents of the Channel Islands, Guernsey, Jersey and Isle of Man.
One entry is allowed per adult.

Participants are informed and accept that the information provided in the Draw entry form constitutes proof of their identity. On reception, Participants are bound by the information they have provided.

All Participants undertake to complete the entry form in good faith and are informed that any inaccurate or incomplete entry forms will be excluded, as will multiple entries.
All Participants confirm that the information they provide, which is stored in the Organizers’ computer systems, is accurate and constitutes proof of their identity.
Participants may inform the Organizer of any change in their personal data by telephoning the Clarins Customer Service on 01279 774215 and/or by e-mail to the following address:

The Form also contains an “OPT IN” box that Participants tick if they agree to receive the newsletter and/or offers from the Organizer. It is specified that participation in the Draw does not depend on the Participants agreeing to tick the OPT IN box.

The Organizer reserves the right to use the information contained in the entry form in compliance with the provisions of the French Data Protection Law 78-17 of 6 January 1978. All participants may oppose, access and rectify information concerning them by contacting the Clarins Customer Service by telephone on 01279 774215 and/or by e-mail at the following address: customer.relations@clarins.co.uk , WESTEX LTD (E COMMERCE), UNIT 1, TEMPLE HOUSE, RIVERWAY, HARLOW, ESSEX CM20 2EY.


Article 3 - Prizes

Prizes are ten (10) lots consisting of ten (10) products, with a recommended retail value of two hundred and sixty eight pounds (£268) Sterling.

Each winning lot contains:

- Instant Smooth Perfecting Touch 15ml
- Tonic Body Treatment Oil 100ml
- Moisture-Rich Body Lotion 200ml

- ClarinsMen Super Moisture Balm 50ml

The value indicated for the aforementioned prizes corresponds to the retail price, including VAT, generally applied in France on the https://www.clarins.co.uk website or estimated on the date of drawing up the present rules.

Article 4 – Attribution of the winning lots

Winning status is subject to the validity of the Participant’s entry.

Before receiving their prize, winners must fulfil the conditions defined in the present Rules and provide proof of their identity.

Winners will be personally notified, in an e-mail sent to the electronic address indicated in the entry form duly completed by each Participant, of the procedure for awarding their winning lot, with which they must comply in order to receive it.

In the case of a winner of one of the available lots failing to respond to the request of the Organizer within a period of eight (8) working days as from the e-mail contact, the Organizer reserves the right to award the lot to an alternative prize winner.

Prizes will be sent to winners by post. Winners will be informed via e-mail in order to get their postal address. The Organizer cannot be held responsible for any problems that may occur during the delivery of the prize.

Neither can the Organizer be held responsible, for any reason whatsoever, in the event of loss of a prize due to the negligence of the winner(s).
Winners are not entitled to any exchange or any consideration in cash or in any other form whatsoever.


Article 5 –Registration of the Rules

The complete Rules of the Draw can be consulted on the tab provided for this purpose on https://www.clarins.co.uk website.
These Rules have been registered with the Bailiff, Maître Richard, 164 av Charles de Gaulle, 92200 Neuilly-sur-Seine, France.


Article 6 – Internet – Telecommunication

Participation in the Draw implies knowledge and acceptance of the characteristics and limits of the Internet, telecommunications – in particular as regards technical performance - , the response time required to consult, request or transfer information, the risk of interruption and, more generally, the risks inherent in all connections and transmissions on the Internet or cell phones, the absence of protection of certain data against potential misappropriation and the risks of contamination by any viruses circulating on the network.

Subsequently, the Organizer cannot in any way be held responsible, without the following list being exhaustive, for:
- The content of services consulted on the Site and, in general, any information and/or data displayed on the services consulted on the https://www.clarins.co.uk website,
- The transmission and/or reception of all data and/or information on the Internet,
- Any dysfunction of the Internet network hindering the smooth performance/functioning of the Draw,
- The failure of any reception equipment or lines of communication,
- The loss of any paper or electronic mail and, more generally, the loss of any data,
- Delivery problems,
- The functioning of any software,
- The consequences of any virus, computer bug, anomaly or technical failure,
- Any damage caused to a Participant’s computer,
- Any technical, material or software failure of any kind that has prevented or restricted the possibility of participating in the Draw or damaged the Participant’s system.

It is stipulated that the Organizer cannot be held responsible for any direct or indirect damage resulting from an interruption, a dysfunction of any nature, a suspension or the end of the Draw, and this, for whatever reason, in addition to any direct or indirect damage that may in any way result from a connection to the https://www.clarins.co.uk website. It is the responsibility of all Participants to take all appropriate measures to protect their own data and/or applications stored on their IT equipment from any breach.

Connection costs will be reimbursed only by bank transfer and in the currency of the applicant's country of residence, following a simple request formulated by any participant under the following terms, together with the postage costs of the request.

The application for reimbursement must be made on plain paper and contain, for verification purposes, the Participant’s last name, first name and personal postal address, together with the connection date(s) and time(s) during which the information was provided on the https://www.clarins.co.uk website. A bank details slip MUST be attached. This request must be sent by post no later than three days following the Draw closing date, with the postmark constituting proof, to the following address: Soci!t! Clarins, Service Internet, 9 rue du Commandant Pilot, 92200 Neuilly sur Seine, France.

Furthermore, any reimbursement, by definition, may only be made if there has been genuine disbursement on the part of the Participant, subject to prosecution on the grounds of fraud.

The Organizer reserves the right to perform any verification it deems necessary, to request any proof and undertake any subsequent legal proceedings.

Connection costs following this application will be reimbursed within thirty days following reception of the request, calculated as follows:

For connection costs: the fixed amount is set at €0.61, based on a connection period that is largely sufficient to complete the requested information, at the maximum current rate.

One request for the reimbursement of connection costs will be accepted per participant (same name, same postal and electronic address) throughout the duration of the Draw.


Article 7 - Disputes

Participation in the Draw implies full acceptance of the present Rules by the participant. Any complaint must be sent in writing to the Organizer’s registered head offices within eight calendar days. Once this period has expired, no complaints will be accepted.

The Organizer shall alone be responsible for settling any dispute involving the application of the present Rules.

The Organizer cannot be held responsible for the Draw being modified, shortened or canceled due to an event of force majeure or any other event beyond its control. In the case of a dispute or disagreement, the Management of the Organizer shall be the sole decision maker. No appeal may be made against any decision taken by the Organizer.
The Organizer reserves the right to bring legal proceedings against any fraud or attempted fraud. It cannot however be held responsible in any way as regards Participants on account of any fraud that may have been committed.

The present Rules are exclusively governed by French law.


Article 8- Changes to the rules

The Organizer reserves the right to shorten, extend, postpone, modify or cancel the Draw, if circumstances so require. It cannot be held responsible and no financial contribution can be claimed.
In the case of a dispute or disagreement, the Management of the Organizer shall be the sole decision maker. No appeal may be made against any decision taken by the Organizer.
In all events, it reserves the right to extend the period of participation and to postpone any announced date.
The Organizer reserves the right to cancel the Draw, not to award the prizes and to bring legal proceedings against any fraud or attempted fraud. It cannot however be held responsible in any way as regards Participants on account of any fraud that may have been committed.
