dla refusal

i asked the dla to look at my childs claim again after i was refused and again it was refused i cant face a tribunal, when can i put in a fresh dla form or is this not allowed x
mother of 3 great kids (well they do try lol)
1 girl age 17 (who has adhd and dyslexia)

2 boys age 13 autistic and 14 year old ADHD/ODD /COLOR]

    it makes me sick,we go to tribunals all the time..its degrading and like being in court..explaining to four people about your childs disability.My child was born with his but we still have to go...be going again soon

    you can make a new claim6 months from the date that the forst claim was made

    I am unaware of any time limit for a fresh DLA application.
    Can you supply any reference for this?

    I made my first claim last August and was awarded LRC, went to Tribunal (only for the care component) in November with no change. So put in new claim just after Tribunal late November and was awarded MRC & HRM.

    So no six months gap?

    I don't think there is any time limit regarding re-application for DLA (unlike ESA).
  • I would be inclined to go to the tribunal/appeal. At least then if it goes in your favour any payment will be back dated. Good luck.

    It is a video by the tribunals service explaining their procedure.
    This is specifically for ESA, but a DLA tribunal is mostly identical.
  • i am too late to ask for a tribunal now,(ive had loads to deal with as my youngest son has just been diagnosed with autism, already get dla for him) so thats why i was asking about reapplying

    You do know that you have one month after the refusal of the reconsideration to make an appeal?
    And that you can still make a 'late appeal' - if you have good cause for not making an appeal at the time up to 13 months after the decision?
    If you're outside the month, practically a fresh application, ideally with more evidence if you can supply it, may be the better option, as the late appeal may be refused, but take some time to be refused.
