Hi...we have an interest in a property. It is set within the land of a much larger property...but with access via shared road.We are concerned that the owner / future owner may want to "develop" this surrounding land.
Can we find out if this has a restriction before we embark on serious offers and conveyency work? thanks.

Unless you have significant legal and planning knowledge you are likely to get yourself confused by trying to investigate this.
It is unlikely to be straightforward.
Start by instructing a solicitor. Sorry, but for a point like that there is no easy way - and unfortunately even once a solicitor looks into it he may not be able to give a definite clear answer.RICHARD WEBSTER
As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.0 -
Thanks Richard...I had fully intended to do it via a Solicitor...I wanted to know if he would do it without entering into a full conveyancy deal.0

Richard may correct me but I guess there are two potential ways to get a preliminary view:
1) speak to the local planning office. Take with you a map showing the location, and a Plan of the property. Ask the hypethetical question "if a planning application was put in for an additional property/10 additional properties /whatever, would it be likely to be approved or rejected"
Whatever answer you get will be no guarantee - just an indication of the opinion of the Officer you speak to
2) Look at the Title for the property in question. Does it either specifically state any restriction, or does it refer to a convayance/covenant that may restrict development?0
