PPI claim outwith trust deed

HI there just a wee enquiry regarding my trust deed. I have now completed it but not discharged yet, I have contacted my IP who has informed me that they want to pursue PPI claims which I assumed were on the debts included in my trust deed. My wife had put in a ppi claim on a secured loan we got years ago which is paid off and not included in my trust deed. The claim has been successful and my question is should I inform the IP? Would the IP be able to claim back these funds even though the debt is not included in the Trust deed and was a joint account with my wife. Are IP allowed to claim back any ppi payments from debts outwith the trust deed? Would this be viewed as a windfall? Any help/advice would be greatly appreciated. Many thanks!!

  • If you have not yet been discharged you will still be bound by the terms of your Trust Deed and as such may be required to pay your half of the PPI proceeds into your Trust Deed.

    It will fall under the "Aquirenda" rule. Maybe have a chat to your Trustee to see what they say.
