Amazon Seller/Courier issue

I purchased an item from an Amazon seller in June and they used Collect+ as their courier.

After much chasing Collect+ deemed the item missing and the seller began their claims procedure saying that I'd be refunded when they paid them.

The item has today been shoved though the letterbox while I was at work. The packaging has been badly damaged, has huge holes in it with some contents coming out. I have no idea if all the contents are in the package. Someone has attempted to tape the package together but it still has gaping holes in it.

We needed the item for July, but as it has been delivered so late it's no longer required even if it is all in the package.

Where do I stand to get my money back from the seller?

I am happy to return the item to them and I've not opened the package as I will be taking photos as evidence.

    Did you cancel the order with the seller, due to non-delivery? If yes then they should have refunded you within 30 days irrespective of whether the item was returned, or whether they had been reimbursed by THEIR courier.

    No I didn't think to cancel the order due to non delivery - once it was declared lost and they started their claim I left it.

    Their claim with the courier is independent to your rights to cancel.

    As it stands you can still cancel... in fact you can cancel within 7 working days from receiving the goods. Since the item is damaged the seller should also pay return costs, although maybe easier to just return it and be done with it.

    None the less, if more than 30 days have passed demand the refund is issued. Otherwise open an A-Z claim

    This is correct (Distance Selling Regs) as long it was Buy it Now (not auction) and the seller was a business seller. They should also be UK-based (although within the EU there will similar legislation, but the fine details will be country dependent).
