Mis-sold Car Warranty

I took out a electrical and mechanical car warranty for 3years at the cost of £1095.00 and it was supposed to be an all singing alldancing warranty or so we were told by the dealer. We thought it was a goodthing to do as the BMW Series 5 Estate had nearly 100,000 on the clock so theodd's of it was going wrong was very high.



We only had the car 5 months and the Turbo pack in !!!! wecontacted the warranty company (Warranty 2000) and they asked us to take it toa garage to find out why the turbo failed !!!!!!



The garage said it was wear and tear !!!!!! we only clockedup 4000 miles in 5 months so wear and tear should not have come into it.

The warranty company said it was not covered under warranty andwe would have to foot the bill of £1180.40 !!!!!!!!!

We contacted the garage we bought the car from as I read athread on the consumer action group and that a garage is obliged to rectify anyfaults up to 6 months.

They were not interested and said they could repair the carat a discounted price !!!!

We are out of pocket in a big way and we are looking for away we can have our warranted refunded and also have some compensation from thegarage we bought the car from.

Contacted the warranty company and the garage we bought thecar from via phone and email and were very unhelpful

under SOGA youhave protection for the first 6 months of ownership when buying a used car. Anydefect which occurs within that time is assumed to be present at the point ofsale.
Could anyone advise us on how we can get our money back please.

    You do have proof of a full service history whilst in your ownership? I don't see how i as missold, as warranty companies have never to my knowledge ever covered items that fail under wear and tear, and any consequential damage this may cause.

    This is an insurance policy, and the terms are as stated in the policy, so trying to get a refund will be a non starter. It is vital that anyone with a warranty retains an ongoing service record to provide documentation to reject any warranty rejection - but many don't bother, mistakenly thinking it is cheaper to claim on the warranty than have a service.

    The mileage of the car was borderline excessive - but SOGA does not guarantee it will be perfect and fault free, the garage offering a discounted repair will be seen as a reasonable response - it may be the cheaper option to get yourself back on the road.

    Where does soga allow 6 months warranty on a 10000 mile used car?

    Check the policy wording and see if you have been correctly advised you aren't covered.
