Advertising something they do not sell?

Well, it sounds like a mistake, doesn't it?
Why not just leave it at that?
I can't see the point of telling them you will call Trading Standards simply because the store made a mistake with their stock. What do you expect Trading Standards to do? Force them to stock the item?
They made a mistake. It happens. Move on.
Sorry if that upsets you.0 -
Sellers can be prosecuted for deliberately advertising something that is not available at that price.
Obviously mistakes can happen, but if it is pointed to them and they continue to misleadingly advertise it at the wrong price, this could be an offence.
It is also true that they don't have to sell it to at the advertised price as this is considered an invitation to treat.

Thank you so much for your constructive advice. I had no idea where I stood on the matter and was interested to know as I had been led a merry dance by the company ie sent to two stores quite a distance from each other!0 -
This reminded me of something from wayback - punchline to a joke (I think)
" It Says Tetleys Tea on the side of buses, but they don't sell it "
Sorry op.
I'd actually be quite naffed off as well if they'd sent me on two wild goose chases.0 -

Their not saying they dont have it at that price though, their saying they dont actually have it.
When they looked into it further, they informed the OP of this and im guessing apologised.
The OP hasnt stated what he wants to get out of this situation yet.0 -

Glad someone has a sense of humour on this forum! Thanks for lightening things up.
I have resigned myself to the fact that I really do not have any rights, it may or may not have been a mistake but at the end of the day I am the one that has lost out on this one due to the wild goose chase!0 -

You keep on going on about your rights but I don't see what you thought the outcome could be! The store doesn't have the phone in stock, so there is no way they can give you the phone!
Did you think there was a consumer law that forced the shop to get this phone in stock to sell you?
In this situation the best you could have hoped for was a goodwill gesture from the shop. However after you threatened them with trading standards that was never going to be on the cards! This is a system account and does not represent a real person. I think you have every right to be annoyed myself. As others have said you aren't entitled to anything rights wise, but they have wasted your time, so you are entitled to a rant about them.
You should name the company concerned to warn others of their customer service.0 -
Then they can take the phone off the webpages, stop advertising nonexistent stock products thus not waste peoples time when they're shopping. The store doesn't have the phone in stock, so there is no way they can give you the phone!0 -
