Student and ESA

Hi everyone,

As many other MSEs, I have shadowed the website (and the forum) from the time Martin was on GMTV lol.



My questions are:

My friend has finished college this July and he is planning to go to University in October.

As far as I am aware full time students who are reciept of DLA (which he is) are exempt from the medical for ESA as they have limited capacity for work.

1.) I just wanted to check if this was true?

2.) Also if the above is true, would he just have to complete
the ESA50 form?


I have checked Disability Right's website but couldn't find anything around question 2 on their site.

    It's not true!

    Normally full time students cannot claim ESA, being in receipt of DLA means they can, not that they automatically have LCW.

    On the Disability Rights website it says:

    "If you are in advanced education, whether under or over 19, you will also automatically count as having limited capability for work if you get DLA.".

    Hi time2save

    As he has finished college and is going onto university I wouldn't think he would be classed as a student during the period in between. (As he has finished one course and is now due to start another.) If he was between years of a college or University course he would be classed as a student over the summer break - if that makes sense.

    I can't help you with the query though, but that might be something to bear in mind or to clarify with the DWP.

    You are right my apologies, I think they will stilll have to complete an ESA50 as they still have to be assessed for the WRAG or the Support Group.

    One of the oddities of or ESA as DLA claimants receiving HRC and HRM can still fail to qualify for ESA.
