roof garden being installed opposite our flat

Hi, I wonder if anyone can give me some information on this.

We woke up this morning to discover that builders are installing metal railings around the flat roof of the building next to ours. This is slightly distressing as a roof terrace will destroy any privacy that we have. We live in a flat within a converted church with large windows, and the residents will have a lovely view of our living room and second bedroom! The roof terrace is approximately five metres from the living room, and on the same level. I'd be pretty upset to have to live with closed curtains all summer!

I suspect that this will have a major impact on the value of our property too.

Would they have required planning permission for this? We have not received any details, and cannot find any applications when looking online.

    Phone the council's planning dept and ask

    This is the best course of action. Exactly this happened to a friend with neighbours putting a balcony around a flat roof. All had to be removed because it overlooked other back gardens.

    The people using the roof terrace might not be too pleased at having you looking out at them.
    A quick enquiry with the planning dept will soon sort out as to whether they have actually applied for permission. Our neighbours are rebuilding a conservatory into a proper extension with a balcony. We received notification from the council almost immediately asking for our opinion on the job. If you have not heard from the council yet, it would appear that they might well be doing the work without permission.
    I can afford anything that I want.

  • i own a terraced house, from 2 bedrooms i can see into one of their rooms, they can do the same to me

    coz of the layout i can only see a strip of my garden from looking out the windows, but full view of next doors garden, vise versa

    so i dunno that yours would be not allowed

  • Yes this needs planning permission. It is development and it cannot be permitted development (PD), as flats have no PD rights.
